The UAE Federal Tax Office (" FTA ") has issued a public clarification VATP017 "Time limit for Claiming Input Tax Deductions". VATP017 clarifies the FTA on when input tax can be credited through VAT and the recourse available to taxpayers who fail to declare input tax within the specified time.

The statement clarified the FTA's position on the interpretation of article 55 of the VALUE-ADDED Tax Act and discussed the need to deduct input tax time limit.

statement summary

Input tax must be deducted during the first reporting period when the following two conditions are met:

1.taxpayer receives the receipt invoice;

2.taxpayer intends to make the payment within six months of the agreed payment date.

After receiving the tax invoice, the taxpayer can only deduct input tax if he intends to make payment within the specified period. Therefore, if the payment is made later than the date on which the invoice is received, the input tax is only deductible in subsequent tax periods.

Recall that section 55 (1) of the previously enacted VAT Law provides that input tax must be deductible during the first filing period if:

1. taxpayer receives the tax invoice;

2.taxpayer completes the payment.
